Terms of Sale

By placing an order on velo.com (the “Site”), you agree to be bound by these Terms of Sale (the “Terms of Sale”).

PLEASE REVIEW THESE TERMS OF SALE CAREFULLY AS THESE TERMS GOVERN YOUR PURCHASE OF “PRODUCTS” FROM RJR Vapor Co., LLC (“RVC”, “we”, or “us”). As used herein, “Products” refers to Velo brand devices, components, and accessories available for sale on Velo.com.

RVC limits acceptance to these Terms of Sale, and objects to any other additional or different terms in the purchaser's purchase order or acceptance.


You must be at least 21 years of age to order Products from the Site.

Title & Ownership
All Products purchased from the Site are sold in North Carolina (“NC”), and title passes to the buyer in NC. Certain state and local jurisdictions have their own laws and regulations related to Products sold on the Site. Please check with your appropriate agencies. Each individual accepts responsibility for ensuring compliance with their state and local laws related to purchasing Products. We make no representation regarding the legal rights of anyone to ship or import Nicotine Products into any state outside of NC. By completing and submitting an order form, you authorize us to act on your behalf in shipping the order, including engaging a common carrier to deliver your order. All purchases made from the Site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Product Availability
Although we make every effort to keep sufficient stock of items listed on our Site, occasionally we do sell out of certain Products. If we are out of stock on an item that you've ordered, we will notify you via e-mail. Any changes will be reflected in your order total as well as your shipping confirmation. We reserve the right to limit the quantity of Products we supply; supply only part of an order or to divide up an order; to reject all or part of an order; and to discontinue Products without notice, even if you have already placed your order.

The images of the Products and packaging on our Site are for illustrative purposes only. Appearance of Products may vary slightly from those images.

Order Processing

All orders are subject to final approval by us. We reserve the right to:
* Request additional information to confirm your identity and order.
* Refuse any order in our sole discretion.
* Ship the order to the billing address for the credit card used to make the purchase. The billing information provided must be able to be verified and must match what your bank has on file.

If additional verification is needed, shipment of your order may be delayed.
In addition, your order may be subject to federal, state, or local restrictions.

When you place an order on our Site, we will only charge your credit card once we have verified your age and card details, received credit authorization, and begun processing your order for shipment. Prior to this, your credit card will be authorized for the amount of your purchase. This is a standard practice related to card verification and does not reflect an additional charge to you.

Orders We Cannot Fulfill
If we are unable to accept your order, in whole or in part, we will inform you of this and will not charge you for the Vapor Products that cannot be ordered. This might be because: the item(s) you ordered are out of stock, there are legal restrictions in your area, we have identified an error in the price or description of the Product, we are unable to meet a delivery deadline you have specified, or any other reason we deem appropriate.

Order Cancellation
We endeavor to process your order and prepare it for shipment as quickly as possible. Order processing begins once your order is submitted on the checkout page and cannot be recalled. After an order has been processed, you can contact our contact center at 1-866-255-1780 for assistance facilitating a refund.

No Resale
Products sold on this Site are available to end-user adult (age 21+) nicotine consumers only. You may not purchase Products from this Site for resale. We reserve the right to refuse or cancel your order if we suspect you are purchasing Products for resale.

Maintaining Account Confidentiality
You are responsible for maintaining the confidentiality of your username and password for the Site and for restricting access to your computer. You are solely responsible for all activities that occur when someone logs in to the Site using your username and password. If you suspect your account information has been compromised, you should change your password immediately and report any suspicious activity to Customer Service at 1-866-255-1780.

Auto-ship Orders

You can sign-up to have future shipments of selected Velo Products auto-shipped to you. You can check the frequency that you want to have Products shipped either on the product detail page or on the check-out page. You may cancel or change your delivery anytime by going to My Account and selecting Your Recurring Delivery to manage your orders. Unless you specify otherwise, the payment method you selected when setting up the auto-shipment will be charged for all future auto-shipments. Before we send your next order, we will send you an e-mail letting you know your order will be processed soon, giving you time to make updates to your recurring deliveries as necessary.

Please note that auto-ship orders typically cannot be changed or canceled online within 48 hours of a scheduled auto-shipment. If you wish to change or cancel your auto-ship order within 48 hours before shipment, please contact Customer Service at 1-866-255-1780. We cannot guarantee your ability to change or cancel an auto-ship order within 48 hours of a scheduled shipment.

If payment for an auto-ship order fails or is not accepted for any reason, the order will be placed “on hold” until such time as payment is made by you. We will endeavor to contact you to let you know if your order is placed on hold. In our sole discretion, we reserve the right to terminate your participation in the auto-ship program if an order remains on hold.

Pricing & Payment

Product prices do not include taxes (if applicable) and shipping charges. Tax and shipping charges will be added at checkout. The tax and shipping charges shown during the checkout process are an estimate and are subject to verification. Final charges will be reflected when your order is processed. Nothing contained in these terms should be construed in any way to waive or limit our rights to obtain payment for products purchased, including any applicable taxes for which the company pays.

Review Prior to Purchase
Prior to submitting your payment information, you will have the opportunity to review product prices as well as estimated taxes and shipping and handling charges.

All prices for Products (and the associated costs of shipping and tax) are shown in U.S. dollars.

Sales Tax
Applicable sales tax will be calculated and added to your order during checkout. The amount of tax charged, if any, is based on the tax laws in effect in the jurisdiction to which the ordered product will be shipped.

State Excise Tax
Where applicable, state and local excise tax will be added to the price of all items, as required by law. The amount of tax charged is based on the tax laws in effect in the jurisdiction to which the ordered product will be shipped.

Despite our efforts, occasional pricing or availability errors may occur. Errors will be corrected when discovered. We reserve the right to cancel any order you have placed if there was an error concerning the price or availability of any item you ordered, even if you have received an order receipt or shipping confirmation. We are under no obligation to provide the product to you at the incorrect price, even after we have sent an order receipt or a shipping confirmation to you.

Method of Payment
Orders must be paid for by credit card only. We accept:

By submitting your order, you represent and warrant that you are authorized to use the designated credit card and authorize us to charge your order (including taxes and shipping and handling fees) to that credit card. If the credit card cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled.

Refunds and Returns

At our discretion, we may require return of the Product before processing your refund. We do not take title to returned items until the item arrives at our fulfillment center. At your request, we will refund the price you paid for the product(s) being returned, including taxes, provided you comply with any return requests. Shipping and handling fees will not be refunded. You will be responsible for paying any return shipping costs. At our discretion, a twenty-percent (20%) restocking fee may be applied to your return.

Shipping and Delivery

Adult Signature Required
Certain purchases may require an adult signature upon delivery (adult providing signature must be 21 years old or older with proper identification of age). These orders cannot be left in a specified location without adult signature. Please keep this in mind when entering your delivery address information.

Shipping Delays
Title to product passes from us to you upon shipment, and we are not responsible for any shipping delays, product damage, losses, or other problems once the product has been shipped.

Shipping Charges
Shipping charges will be included on your invoice and an estimate of these charges can be viewed prior to finalizing your order.

Where We Ship
We only ship to certain states and localities in the United States. We do not ship to P.O. Boxes, AFO/FPO addresses, Guam, Puerto Rico, or the U.S. Virgin Islands. We do not ship to freight forwarders, hotel locations, or any establishments at our discretion that may pose a risk to the security of the package. We will notify you if we determine that we are unable to ship to your delivery address.

When We Ship
We endeavor to ship all orders within two business days. Orders are shipped Monday to Thursday, from 9:00 a.m. to 2:00 p.m., and Friday from 8:00 a.m. to 12:00 Noon, Eastern Time. See our shipping options here.

Once your order has shipped, we will send you an email with the tracking number and a link, which will take you to the website of the shipping carrier that was used to ship your order.

Delivery Attempts
Some delivery carriers may attempt delivery more than once. Shipments that are returned to us as undeliverable for any reason (including, where the provided address information is incorrect or incomplete or an adult was not available to sign for the delivery) will either be reshipped at your expense or refunded, minus applicable shipping & return fees. We will reship the package only after obtaining approval and payment of any return and reshipping fees from you.

Choice of law

These Terms of Sale shall be governed by and construed in accordance with the laws of the State of North Carolina as such laws are applied to agreements entered into and to be performed entirely within North Carolina between North Carolina residents. All disputes concerning any purchase or these Terms of Sale must be brought either in the state courts of Forsyth County, North Carolina USA or in the federal court of the Middle District of North Carolina USA. You voluntarily submit to and consent to the exclusive jurisdiction and venue of such courts.
